Gatundu South MP Moses Kuria and former Machakos Senator Johnson Muthama were yesterday each ordered to sign a Sh1 million security commitment, on top of bail, as they were released over hate speech charges.
Kuria and Muthama, who have been in custody since their arrest on Monday over incitement to violence, were freed on a Sh300,000 bail each after they denied the charges.
The two have previously been charged with similar offences. They appeared before Nairobi chief magistrate Francis Andayi.
The Sh1 million imposed by the court is a personal commitment they will adhere to the rule of law and not commit similar offences.
However, unlike in previous occasions when the prosecution had put up spirited fight to block their release on bail, this time, there were no objections.
Although Andayi freed the two on Sh300,000 bail, and an alternative of Sh500,000 bond, he went ahead and ordered the duo to sign a personal recoginsance of Sh1 million.
A recoginsance fee is a security entered into before a court with a condition to perform some act required by law. The sum is forfeited if the suspect breaches the condition.
Andayi said should the two get themselves in trouble and are arrested again, they will automatically lose the security.
Muthama, was accused of stating: “Mimi nataka kumwambia na naalika Uhuru Kenyatta na Mheshimiwa Ruto pale Uhuru Park bila askari na mimi na Orengo tuvae gloves tukutane Uhuru Park, tuonyeshe kilicho nyoya kanga manyoya. Unatisha Raila kama nani?”
The prosecution said the words indicated it was desirable to engage in physical fight and were also calculated to cause death or injury.
Kuria on his part was accused of making abusive messages at Wangige Market on September 5.
Kuria allegedly said: “The razor blade is the same one to shave Raila again, to circumcise and shave his wife’s pubic hair”.
The trial will begin on January 23.
